of Article 1 of the Counter-draft as it at present stands.

It is clear, however, that this question of unregistered

marks is at the root of the whole mattor, and that, if no

satisfactory arrangement can be effected regarding it, the

negotiations for the Convention cannot proceed.

The Board agree to ir Crowe's suggestion that Article

3 of the counter-draft might be quitted.

As to Article 4, this was retained from the raft

Convention between Japan and France which was submitted to Ilie Fajesty's Goverment by the former as a basis for nego- tiation. It was thought that the Japanese might attach importance to it, and it seemed on the whole unobjectionable. There is no objection however, on the part of the Board of Trade to its omission, but the question of its inclusion, as also the question as to article 3 referred to above, is one upon which the Colonial Office would probably desire to

be consulted.

I am to enclose a rovised Counter-Draft of Convention which, if Sir 2. Oray approves, might be submitted to the Japanese Government for their consideration. The Board asouse that it will be possible to vest His Hajesty's Con- sular Courts in China with power to apply the provisions of the proposed Article 2 in respect of unregistered marks by Order in Council, but this is a point which no doubt the Foreign Office will determine.
